# Food and drink

> Imported candy, snack boxes and treats. Check your state's rules, labels and dates before you go on camera.

Food sells well on live shows because buyers like watching an unboxing of chips and candy they can't find at their local store. Selling from your spare room doesn't exempt you from food law.

Most home sellers resell sealed, labeled products bought from a distributor or wholesale club. That route is simpler: the maker's label already carries ingredients, allergens and a date.

If you bake or pack food at home, your state's cottage food law decides what you can sell, whether you can ship it and whether you need a permit. The rules differ a lot from state to state.

## How to pack it

- Seal drinks and anything that could leak in a plastic bag.
- Box the order and fill every gap with paper so cans and packets can't move.
- Ship it tracked early in the week, and hold chocolate back in hot weather.

Avoid: Chips and cookies in a poly mailer. They arrive as crumbs.

- **[Small corrugated boxes, 25 pack](https://sellersetups.com/us/product/single-wall-boxes)** ($12 to $25): Use these for boxed toys and beauty sets that a poly mailer would crush, when double-wall board costs more than you need.
- **[Honeycomb paper wrap roll](https://sellersetups.com/us/product/paper-void-fill)** ($20 to $35): Stretches into a cushioned mesh and goes in the paper recycling. Choose it if low-plastic packaging is part of your shop's pitch.
- **[Bubble wrap, 12 in x 175 ft](https://sellersetups.com/us/product/bubble-wrap-roll)** ($15 to $30): A long perforated roll costs several times less per foot than the small packs sold at the post office or a drugstore.
- **[4 × 6 in thermal labels, 500 fanfold](https://sellersetups.com/us/product/thermal-labels-fanfold)** ($8 to $16): Fanfold stacks feed flat behind the printer and hold more labels than a roll. 4 × 6 in matches the label size USPS, UPS and the marketplaces print.

## Rules and the paperwork to do first

Call or check the website of your state or county health department and ask what applies to your product line. Reselling sealed, packaged goods is the lighter route, and some states need nothing extra for it.

Baking or repacking bulk candy into bags puts you under your state's cottage food law, if it covers that food at all. Expect label rules and sales caps, and in some states a permit or inspection.

Keep a simple record of where each batch came from, with the supplier invoice. If a product is recalled, you can see straight away which orders it went into.

## Popular lines and where to source them

Imported chips, sodas, Japanese snacks and limited-edition candy bars are the staples of food shows on Whatnot and TikTok Shop. Sell mystery snack boxes at one price per box.

Buy from US importers and distributors that supply English labels and stand behind FDA compliance. Products bought off a store shelf abroad may miss US labeling rules or contain ingredients that aren't allowed here.

## Labels, allergens and dates

Sealed products from a US importer carry the label already. Check it lists ingredients, the major allergens, net weight and the name and address of the maker or distributor.

Put the best by date in the listing for anything with less than three months left. If a buyer opens a box of short-dated candy without warning, expect a refund request.

## Showing snacks on a live show

Hold each package up to the camera with the front facing out, then turn it to show the date. Buyers on food shows ask about flavor and size more than condition, so keep one open sample of each line on the desk to describe.

Keep chocolate off the desk under the ring light, where it softens during a long show.

## Packing food so it arrives whole

Use a box for anything that crushes. Chips and cookies break in a poly mailer, and cans dent each other without padding between them.

Bag drinks in a sealed plastic bag before they go in the box, so a leak stays in the bag. Fill the gaps with paper so nothing moves when you shake the box.

## Shipping, heat and summer orders

Ship food with tracking, such as USPS Ground Advantage, so you can see where a package is if it's delayed. Avoid shipping chocolate on a Thursday or Friday in hot weather, when it can sit in a warm truck or facility over the weekend.

In summer, you can pause chocolate lines or add a note that melting in transit isn't covered. Put it in the listing before the sale.

## Common mistakes

- Ask your state or county health department what applies before you sell, especially anything you made at home.
- If you buy imported candy from an unchecked source, you may stock recalled or mislabeled products, so use a US importer.
- Chips shipped in a poly mailer arrive as crumbs and come back as a refund request, so box anything that crushes.
- If you leave the best by date out of the listing, buyers return short-dated stock, so show the date on camera and in the text.
- Cans packed against each other with no padding dent and leak, so wrap each one or divide them with paper.

## Questions

### Do I need a permit to sell food from home?

It depends on your state and what you sell. Reselling sealed, packaged food is treated differently from making it yourself. Check with your state or county health department before you start, and read your platform's food policy.

### Can I sell imported candy and snacks?

Imported food must meet FDA rules, including an English label with ingredients and allergens. Some imported candy has been recalled for additives or ingredients not allowed in the US. Buy from a US importer or distributor, and check FDA recall notices for lines you stock.

### Can I sell food past its best by date?

Federal law doesn't require date labels on most foods, and a best by date is about quality rather than safety. Some states regulate date-labeled food, so check yours. Tell buyers the date in the listing and price short-dated stock lower.

### Can I sell homemade baked goods?

Most states allow some homemade foods under a cottage food law, but many limit sales to in person or within the state, cap yearly sales or require a label. Some ban shipping. Check your state's rules before you list anything you made.

### Can I sell alcohol on Whatnot or eBay?

Selling alcohol needs a state license, and shipping it to consumers is tightly restricted. Most marketplaces ban it for home sellers. Check your platform's restricted items page before you list anything with alcohol in it.

### Can I ship food with USPS?

Sealed, nonperishable food ships fine with USPS. Perishables need fast service and insulation, and alcohol can't go through USPS. Check USPS Publication 52 before you choose a product line.
